SOME THINGS TO REMEMBER WHEN HAVING A CONSULTATION WITH A CLIENT


1. Let him talk. He is the one who has the problem.

2. You listen and absorb all the facts.

3. If you feel that he is going out of track cut him short with polite questions. 

4. Collect all instructions at the 1st consultation. Make every effort to get the instructions in writing. 

5. Collect all documents. Short list the documents.

6. Anticipate the possible position that the other party is likely to take and collect information on such lines. 

7. Collect the names of your witnesses. 

8. Find out more details about the other parties witnesses keeping in mind the opportunity to cross examine and discredit. 

9. Ascertain the capacity to pay fees. 

10. Be punctual at the consultation.

11. Be properly attired. The impression counts a lot. 

12. Maintain notes at the conference.

13. If some other Lawyer has been handling the case before you should not take the case unless the isn't has been wrongly handled or the case has been mishandled.  Even then you must contact the 1st Lawyer and inform him of the intention of the client. Also see whether his professional fees have been settled. If so ask him for a letter stating that he has no objections for you to take over the case. 

14. In a Civil case always see the client with an instructing Attorney.  Never meet the client alone. 

15. In all civil cases all professional fee memos have to be addressed to the instructing Attorney.
